Terms of use
These Terms of Use govern your access to and use of the Comet Fence website. They do not replace a written contract for construction or installation work.
Last updated: April 28, 2026.
Disclaimer. These terms are provided for general business use. They are not legal advice. Have qualified counsel review them for your specific operations, insurance, and licensing posture.
1. Agreement to these terms
By accessing or using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the site. We may change these terms from time to time; the “Last updated” date above will change when we do. Your continued use after changes constitutes acceptance of the revised terms, except where prohibited by law.
2. Who we are
This site is operated by Comet Fence Corporation (“Comet Fence,” “we,” “us,” or “our”), with our principal business address at 1341 N.W. 13th Ave., Pompano Beach, FL 33069. We provide commercial and residential fencing, gates, and related services in South Florida and as otherwise agreed in writing.
3. Permitted use of the website
You may use this website only for lawful purposes and in accordance with these terms. You agree not to:
- Use the site in any way that violates applicable federal, state, or local law or regulation;
- Attempt to gain unauthorized access to our systems, other users’ information, or any networks or servers connected to the site;
- Introduce viruses, malware, scrapers, or other harmful or automated means of access except as allowed by public search engine indexing;
- Impersonate Comet Fence, our employees, or another person, or misrepresent your affiliation with any entity;
- Use information obtained from this site to harass, abuse, or harm another person; or
- Frame or mirror any part of the site without our prior written consent.
4. Online quotes, contact forms, and communications
Forms on this site (including quote and contact requests) are invitations for us to follow up with you. Submitting a form does not create a binding contract for materials, labor, installation, or price. Any proposal, estimate, or contract is subject to a separate written agreement signed by authorized representatives, site conditions, product availability, permit requirements, and other factors we will discuss with you.
You agree that we may contact you at the phone number or email address you provide regarding your inquiry and related services (for example, by telephone or email during our normal business hours). If we offer text messaging in the future, we will obtain any legally required consent separately.
5. Permits, codes, property lines, and homeowner responsibilities
Fence and gate projects can be subject to municipal codes, homeowners’ association rules, utility easements, survey requirements, wind-load and pool-barrier rules in Florida, and other local requirements. Information on this website is general in nature. You are responsible for confirming what applies to your property. Unless expressly included in a signed contract, obtaining permits, surveys, or approvals may be your responsibility or may be addressed in the scope of work we agree to in writing.
6. Intellectual property
The content on this site—including text, graphics, logos, images, page layout, and selection of materials—is owned by Comet Fence or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and print a reasonable number of copies for your personal, non-commercial use related to considering our services. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit our content without prior written permission, except as allowed by law.
7. Accuracy of site content
We work to keep information on this site accurate and up to date. However, product photographs, descriptions, and project examples are illustrative and may not reflect your exact configuration, color, or site conditions. Pricing, lead times, and service areas are subject to change without notice. Always confirm material details and scope in your written proposal or contract.
8. Disclaimer of warranties
THIS WEBSITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, COMET FENCE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMET FENCE, OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THIS WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US (IF ANY) SPECIFICALLY FOR ACCESS TO THE WEBSITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (WHICH IS TYPICALLY ZERO FOR A FREE PUBLIC SITE). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct where prohibited.
10. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Comet Fence and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your violation of these terms, misuse of the website, or violation of another party’s rights—except to the extent caused by our gross negligence or willful misconduct.
11. Governing law and venue
These Terms of Use are governed by the laws of the State of Florida, without regard to conflict-of-law principles that would apply another state’s laws. Subject to the dispute section below and mandatory consumer protections where you reside, you agree that the state and federal courts located in Broward County, Florida, shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or the website that is filed in court, and you waive any objection to venue in those courts.
12. Dispute resolution
Before initiating any formal proceeding, you agree to contact us at usa@cometfence.com or 954-975-6401 and give us at least thirty (30) days to try to resolve the dispute informally. If informal resolution fails, either party may pursue remedies available at law or in equity in accordance with Section 11, unless applicable law requires a different mandatory forum (for example, small claims court where you qualify).
13. Electronic communications
You consent to receive communications from us electronically, including email and postings on this site, and agree that those communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.
14. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
